DEFINITIONS

In these conditions, the following words shall have the following meanings: –

Company” Teal and Hawthorn Logistics Ltd trading as “MyUKCart” under these conditions.

Member” the Person or company on whose behalf the company undertakes any business or provides services.

Suite” the MyUKCart mailbox address assigned to a member where parcels are received and stored for the member

Package” any parcel or consignment addressed to a single address sent and/or received at one time and the contents thereof.

Merchant” is any seller of goods located in the United Kingdom.

Service Agreement” Agreement between the company and the member.

 

TERMS OF SERVICE

By Signing up, a service agreement is made and entered into between the member and the company for the use MyUKCart services under the terms of this service agreement. Any amendment to this

Service agreement shall be published on MyUKCart website from time to time. Any amendment is at the sole discretion of MyUKCart.

  1. MyUKCart will provide the member with a suite at the company’s facility in the United Kingdom where the member can send and store packages to be exported. This suite shall be used for package forwarding purposes only.

 

  1. The Member will not represent that his/her suite is his/her address for any purpose other than that to which packages may be delivered for export, including, but not limited to, representing that its suite is the address of the Member’s place of business or residence. Failure to comply with this requirement may result in the cancellation of MyUKCart membership. Member further agrees that the suite will not be used for any unlawful, illegitimate or fraudulent purpose or for any purpose prohibited by United Kingdom laws.

 

  1. The member appoints the company as agent to receive packages and where applicable, consolidate packages for export. The member agrees that that packages will be opened, sorted, packed and where applicable, consolidated for export.

 

  1. Members authorise the company as its agent to authorise freight forwarder and/or courier companies to conduct customs clearance and entry on packages forwarded for export. Members accept that freight forwarders and/or courier companies reserve the right to open and/or inspect every shipment tendered to forwarders and/or couriers on behalf of MyUKCart Member.

 

  1. Members are obligated to provide MyUKCart with Export Declaration in contents and values prior to package being exported to requested country.

 

  1. Members are responsible for all import obligations in their destination country.

 

  1. The member appoints the company as agent to buy on his/her behalf under the instruction of the member. The company reserves the right to cancel any order which does not conform to MyUKCart service policy.

 

  1. The member authorises the company to charge his/her payment method for all services and/or account activity with MyUKCart. Such charges may include but are not limited to membership subscription, Shop4Me service charges, payment handling fees, shipping and handling charges, return fees, storage charges and any optional services. Failure to provide payment for services rendered at the time of service may result in suspension of service and subsequently, cancellation of membership.

 

  1. Monthly membership fees for Gold and Platinum members are non-refundable.

 

  1. Either party may cancel membership with written notice (email, fax or letter). Upon cancellation, you will receive a prorated refund on any unused portion of your available funds. Refunds will be processed within twelve (12) business days of cancellation. If a member terminates membership and does not renew it, MyUKCart reserves the right to refuse to accept any mail and/or package delivered to Member’s suite after the termination date.

 

  1. If a package arrives at MyUKCart facility with an incomplete or incorrect address, that package will be returned or discarded. It is the responsibility of members to ensure that all packages coming to MyUKCart facility are marked with the complete and accurate address including the member’s unique suite number.

 

  1. MyUKCart will allow active Basic Members to store their packages for up to 10 days at no charge, Gold Members to store their packages for up to 30 days at no charge and Platinum members for up to 60 days at no charge. After the ‘no charge’ period, the Member agrees to pay storage charges per package per day, consistent with MyUKCart schedule of fees for up to 60days.

 

  1. If a package is not collected and/or paid for within the ‘no charge’ storage period and the 60 days paid period, the package will be forfeited and/or destroyed with no liability to the company or any of the company’s personnel.

 

  1. Delivery costs are based on the weight and dimensions of your shipments. Delivery costs will be charged according to the actual weight or dimensional weight, whichever is greater.

 

  1. Prohibited/illegal items are not storable and will be rejected, forfeited, destroyed, or handed to law enforcement if required to.

 

  1. The company will not accept Cash on Delivery (C.O.D) packages unless the member has pre-arranged with the company and has paid for the C.O.D charges in advance.

 

LIABILITY AND LIMITATION

  1. Insurance costs for packages are based on the insured value. The insured value is subject to the terms and conditions of the particular courier company’s insurance policy.

 

  1. The company will be responsible for the member’s suite contents only while it is within the company’s custody and control. The company shall not be liable for loss or damage of the suite

contents while these contents are out of the company’s custody or control. The company’s liability is in any event is limited to Twenty-􀃏ve Great British Pounds (+/- £25) or its equivalent per

shipment regardless of the nature of the claim.

 

  1. Claims for lost or damaged item must be 􀃏led within the published time limits of the particular courier company. Claims are considered 􀃏led when a fully completed claim form, photograph(s),

and supporting documentation, including receipts are received by the company.

 

JURISDICTION AND LAW

  1. These conditions and any act or contract to which they apply shall be governed by English law and any dispute arising out of any act or contract to which these Conditions apply shall be subject

to the exclusive jurisdiction of the English courts.
